PRIVACY POLICY AND COOKIES

 

This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from Virbac Belgique (store.be-fr.virbac.com and store.be-nl.virbac.com)

WHAT PERSONAL INFORMATION WE COLLECT

When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device.

Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically collected information as Device Information.

We collect Device Information using the following technologies:

• Cookies are data files that are placed on your device or computer and often include an anonymous unique identifier.

• Log files track actions occurring on the Site, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.

• Server-side tagging to collect anonymous data for analytics purposes

Also, when you make a purchase or attempt to make a purchase through the Site, we collect certain information from you, including 

• your name, 
• billing address, 
• shipping address, 
• payment information for all accepted payments via iDeal, credit card bearing the acronym VISA, MASTERCARD or MAESTRO or via Paypal or Apple Pay,
• email address, and 
• phone number. 

This is called Order Information.

By Personal Information in this Privacy Policy, we are talking both about Device Information and Order Information.

 

WHY DO WE COLLECT YOUR PERSONAL INFORMATION

We collect your Personal Information to:

• Create your account: if you purchase a product from Virbac Belgique, we will set up a password-protected direct online access to your user-related data saved in the customer account. If you do not wish to have a password-protected customer account, you can, of course, close it at any time. Please send a request in written form (e.g. email and letter) to our contact address. ((Legal basis is Art. 6 (1) lit. b) GDPR)

• Manage your order: if you wish to order from our webshop, the conclusion of the contract requires you to state your personal data or transfer it from the existing customer account. Your given data is essential and necessary to process your order. Information that is required to process the order is marked separately, further information is voluntary. ((Legal basis is Art. 6 (1) lit. b) GDPR).

• Subscribe to Newsletter: On the website of VIRBAC BELGIUM N.V., users are given the opportunity to subscribe to our enterprise's newsletter. VIRBAC BELGIUM N.V. regularly informs its customers, prospects, and business partners via newsletter about:

• New products

• Practical tips

• Product recommendations

• New services

• Vouchers

• Exclusive actions or offers

The VIRBAC’s newsletter may only be received by you if (1) you have a valid email address and (2) you register for newsletter distribution. For legal reasons, a confirmation email will be sent to your email address registered for the newsletter, in accordance with the double opt-in procedure. This confirmation email is used to prove whether – you – the owner of the email address has authorized the reception of the newsletter. ((Legal basis is Art. 6 (1) lit. a) GDPR)

• Product recommendations: as a VIRBAC BELGIUM N.V. customer, you will receive regularly product recommendations and practical tips by email. You will receive these product recommendations irrespective of whether or not you have subscribed to a newsletter. We aim to inform you about our products that might be of interest for you based on your recent purchases. Furthermore, you will receive useful tips for using our products.

If you do not wish to receive any advertising messages from us anymore, you may terminate the subscription at any time. Please write your termination notice in text (email and letter) to our contact address. You will find, of course, a link to unsubscribe at the end of each email. HOW DO WE USE YOUR PERSONAL INFORMATION

We use the Order Information that we collect generally to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations).

Additionally, we use this Order Information to: 

• Communicate with you

• Screen our orders for potential risk or fraud (Legal basis is Art. 6 (1) lit. c) GDPR).

• When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.

We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site.

 

SHARING YOUR PERSONAL INFORMATION

The recipients of your data are the authorized persons within VIRBAC S.A. and VIRBAC BELGIUM N.V. who are in charge of processing, as well as our subcontractors in charge of hosting the internet website and the support service: BIG COMMERCE, ADYEN.

We share your Personal Information with:

• our service providers and to third parties to help us use your Personal Information, as described above;

• third parties, buyers or investors, in the event of a restructuring of the Virbac group; including the total or partial sale of assets, mergers, acquisitions, spin-offs and, more generally, any capital operation

Your data will not be sold to third parties under any circumstances.

 

We also use Google Analytics to help us understand how our customers use Virbac Belgique. To know how Google uses your Personal Information click https://policies.google.com/privacy?hl=en.

Finally, we may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful requests for information we receive, or to otherwise protect our rights.

Furthermore, if you consent, we also use your email address to send advertising for products similar to those you ordered. 

 

BEHAVIOURAL ADVERTISING

Based on your consent, we use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you.

You can opt out of targeted advertising at any time.

 

YOUR RIGHTS

If you are a European resident, you have the right to access the personal information we hold about you and to ask that your personal information is corrected, updated, or deleted. If you would like to exercise this right, please contact us contact@virbac.be.

Additionally, if you are a European resident we note that we are processing your information in order to fulfill contracts we might have with you (for example if you make an order through the Site), or otherwise to pursue our legitimate business interests listed above.

We will do our utmost to respond satisfactorily to your requests. If, for any reason whatsoever, you consider that our response is unsatisfactory, we inform you that you may lodge a complaint with the national supervisory authority. 

 

DATA RETENTION

You can ask for the suspension or the deletion of your account at any time by accessing your profile. 

We retain your personal data for the strict period of time necessary to fulfill the purpose of the  processing concerned. Thus: 

• the data associated with your account is retained as long as you maintain your account and until your account is deleted; however, if you remain inactive for three (3) years (e.g., no login to the Site, no opening of sent emails, etc.), your account will be considered inactive, and we will delete it after a notification email remains unactioned by you for 1 (one) month.

• The data relating to the sending of newsletters and alerts are kept as long as you do not withdraw your consent  by unsubscribing; 

• The data collected in the context of the conclusion of specific contracts are kept for the duration of the execution of the latter, and are then archived for the strict legal prescription periods applicable; 

• The data collected in the context of our legal, fiscal and accounting obligations are kept for the applicable  legal, fiscal and accounting retention periods; 

• The data collected in the context of tax reporting obligations are kept until they are sent to the tax authorities  once a year, and then archived for the strict limitation periods applicable;  

• The data related to the management of complaints, disputes and litigation are kept for the duration necessary  to resolve the dispute and for the duration of any applicable statute of limitations; 

• The documents necessary for the identity verifications which take place within the framework of the fight against  fraud are preserved during the time necessary for the verifications and are removed within 3 (three) days; 

• The answers to surveys are kept for the time necessary for the survey and are then anonymized if they were not  already; 

•  The phone conversation which are recorded are kept for 6 months before erasure;

• The data collected through cookies and tracers on the Platform are kept in accordance with the "cookies"  section of the Policy;  

• The data collected can be kept in a form that does not allow your identification (anonymization) for analytics  and statics purposes, without limitation of duration; 

• In some cases, we may retain certain personal data about you even if you delete your account, by legal  obligation, or if we have an overriding legitimate interest in retaining some of your data (ex. there is an issue with the account, the presence of an unresolved claim or dispute, the defense and exercise of our rights etc.). In  this case, the data necessary for the resolution of the case will be kept for as long as the dispute lasts within the limit of the applicable rules on prescription. 

• When you place an order through the Site, we will maintain your Order Information for our records, and due to commercial and tax law regulations, we are obligated to save your Order Information for a period of ten (10) years. However, after two years upon your last connection or your last purchase, we restrict processing, this means that your data is only used to comply with legal obligations.

 

MINORS

The Site is not intended for individuals under the age of 18 years.

 

CHANGES

We may update this privacy policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons.

ABOUT COOKIES

We use various cookies to enhance the interactivity of the application and the service.

What is a "cookie"? A "cookie" is a string of information, usually small in size and identified by name, that may be transmitted to your browser by a web site to which you connect.
